1. Our policy

Homegoing360 respects intellectual-property rights and expects users to do the same. We respond to notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act (“DMCA”) and will remove or disable access to infringing material and terminate repeat infringers in appropriate circumstances.

2. Designated DMCA agent

Notices of claimed infringement must be sent to our Designated Agent:

3. How to submit a DMCA takedown notice

To be effective, your written notice must include substantially the following (17 U.S.C. §512(c)(3)):

  • Your physical or electronic signature;
  • Identification of the copyrighted work claimed to be infringed, or a representative list;
  • Identification of the allegedly infringing material and information reasonably sufficient to locate it — for example a URL, or a memorial page or account reference;
  • Your contact information: name, address, telephone, email;
  • A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law;
  • A statement, under penalty of perjury, that the information in the notice is accurate and that you are the owner or authorized to act on the owner’s behalf.

Send it to the Designated Agent above. Incomplete notices may not be actionable.

⚠️ Misrepresentation. Under 17 U.S.C. §512(f), anyone who knowingly materially misrepresents that material is infringing — or that it was removed by mistake — may be liable for damages.

4. Our response

Upon receiving a valid notice, we will remove or disable access to the identified material, notify the affected user, and document the action. We will forward the notice, which may include your contact information, to the user who posted the material.

One category cannot be removed by us, and we will tell you rather than ignore you. A sealed recording is fixed at the moment it is sealed and cannot be edited or deleted by anyone, including Homegoing360 — see the Terms of Service, Section 7.6. If a valid notice identifies a sealed recording, we will tell you that promptly and will comply with a court order directing its removal.

5. Counter-notice

If your material was removed and you believe it was a mistake or misidentification, you may submit a written counter-notice to the Designated Agent including substantially:

  • Your physical or electronic signature;
  • Identification of the removed material and its prior location;
  • A statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification;
  • Your name, address, and telephone, and a statement that you consent to the jurisdiction of the federal district court for your address — or, if outside the U.S., for any district in which Homegoing360 may be found — and that you will accept service of process from the person who filed the notice.

Upon a valid counter-notice, we may restore the material in 10–14 business days unless the original complainant notifies us that they have filed a court action seeking to restrain the allegedly infringing activity.

6. Repeat infringers

We will, in appropriate circumstances and in our discretion, terminate accounts of users who are repeat infringers. We may also remove content and restrict features for infringement at any time.

7. Records

We retain DMCA notices, counter-notices, and our responses, with timestamps, for the period set out in the Data Retention Policy.
